‘Buy two products – get the cheaper one at half price’

§ 1. General provisions

1. These terms and conditions (the ‘Terms’) set out the rules of the ‘Buy two products – get the cheaper one at half price’ promotion (the ‘Promotion’) run by the online store at https://berriesandco.pl (the ‘Store’).

2. The organiser of the Promotion and the seller is Berries&Co. spółka z ograniczoną odpowiedzialnością, with its registered office in Warszawa at ul. Mokotowska 46/7, 00-543 Warszawa, entered in the register of entrepreneurs of the National Court Register under KRS number 0001097169, NIP 7010517464, REGON 362910109, with a share capital of 5,000.00 zł (the ‘Organiser’).

3. Matters not governed by these Terms are subject to the Store Terms and Conditions available at https://berriesandco.pl/pages/regulamin and generally applicable law, in particular the Polish Civil Code and the Polish Act of 30 May 2014 on Consumer Rights.

4. The terms used in these Terms have the following meanings:

a) Customer – a person placing an order in the Store; references to female customers apply equally to male customers;

b) Promotional Product – a product offered in the Store when the order is placed, other than an Excluded Product;

c) Excluded Products – the products listed in § 3(1);

d) Regular Price – the price of a product displayed in the Store when the order is placed, before applying the B Club Price, discount codes or Malinki;

e) B Club Price – the price available to members of the B Club programme;

f) Malinki – points awarded under the Organiser’s loyalty programme;

g) Discount – a reduction of 50% of the Regular Price of a Promotional Product, on the terms set out in § 4.

§ 2. Duration and scope of the Promotion

1. The Promotion runs from 29 October 2026 at 00:00:00 until 29 October 2026 at 23:59:59, Polish time. Eligibility for the Promotion is determined by the time the order is placed in the Store.

2. The Promotion applies exclusively in the Store. It does not apply in the Organiser’s physical store or to sales by the Organiser’s trading partners.

3. The Promotion is valid while stocks of Promotional Products last.

4. The Promotion is a conditional offer: the Discount is available only if the condition in § 4(1) is met. The Regular Prices of products remain unchanged during the Promotion.

§ 3. Excluded Products

1. The following products are excluded from the Promotion (Excluded Products):

a) products in the ‘Wyprzedaż’ (Sale) section of the Store (https://berriesandco.pl/collections/promocje);

b) Berries Set sets;

c) Pops sets: Kolczyki Pops Set earrings, Naszyjnik Łańcuszek Pops Set necklaces and Naszyjnik Cord Pops Set necklaces;

d) Bott Mix ring sets;

e) stones for the Secrets necklace, including Diament Sól i Pieprz;

f) gift cards, packaging and services (Torba Berries, separate packaging).

2. The Promotion applies to all other products offered in the Store, including Duo earring sets (Kolczyki Duo Set 1 and Kolczyki Duo Set 2) and Pop Charm pendants.

3. The list of Excluded Products offered in the Store on 27 October 2026 forms Appendix 1 to these Terms. A product belonging to one of the groups listed in paragraph 1 is an Excluded Product even if it is not listed in Appendix 1.

4. Excluded Products may be purchased in the same order as Promotional Products. Excluded Products do not count towards the number of Promotional Products in the order, do not receive the Discount and are sold under the terms applicable in the Store.

§ 4. Promotion rules

1. If the Customer buys two Promotional Products in one order, the cheaper one is purchased at half its Regular Price (the Discount). The products may be identical, for example two identical rings in the same or different sizes.

2. If the order contains more than two Promotional Products, the Discount applies to the cheapest ones: one product for each complete pair of Promotional Products in the order, up to a maximum of three products per order:

2 or 3 Promotional Products – the Discount applies to the 1 cheapest product;

4 or 5 Promotional Products – the Discount applies to the 2 cheapest products;

6 or more Promotional Products – the Discount applies to the 3 cheapest products.

3. If several Promotional Products have the same Regular Price, the Discount applies to the number of products determined under paragraph 2.

4. The Discount is applied automatically in the basket, without a discount code, and is shown in the order summary.

5. The Discount is calculated from the Regular Price. In an order receiving the Discount, Promotional Products are priced at their Regular Price, and the B Club Price does not provide an additional reduction.

6. The Discount cannot be combined with other discounts, promotions or discount codes, including HIBERRIES, MORE and MORE&MORE. An order may use either the Discount or a discount code.

7. Malinki cannot be redeemed in an order receiving the Discount.

8. An order receiving the Discount may be paid for with a gift card; this does not constitute combining the Discount with another promotion.

9. Products in an order receiving the Discount are not packaged separately: they are packaged under the Store’s standard rules.

10. The Customer may use the Promotion in more than one order, while stocks last.

11. The free-delivery threshold specified in the Store Terms and Conditions is calculated from the order value after the Discount has been applied.

12. Examples of how the Discount is calculated (Regular Prices as at 27 October 2026):

§ 5. Withdrawal, returns and complaints

1. The Promotion does not restrict the Customer’s rights, in particular the right to withdraw from the contract, rights relating to goods not conforming to the contract or other rights under the Store Terms and Conditions and mandatory law. The right to withdraw from the contract may be exercised within 30 days, on the terms set out in the Store Terms and Conditions.

2. If the Customer withdraws from part of the contract, meaning that some products from the order are returned, the Organiser recalculates the order: the value of the Promotional Products kept by the Customer is determined under § 4 as if the Customer had ordered only those products.

3. The refund for Promotional Products equals the difference between the amount paid for all Promotional Products in the order and the value of the Promotional Products kept by the Customer, determined in accordance with paragraph 2.

4. In particular:

a) if the Customer keeps only one Promotional Product, it is charged at its Regular Price, without the Discount;

b) if the Customer keeps at least two Promotional Products, the Discount applies to the cheapest ones in accordance with § 4(2);

c) the rules in points (a) and (b) apply regardless of whether the Customer returns a product that received the Discount or a product purchased at its Regular Price.

5. For returned Excluded Products, the Organiser refunds the price paid. Delivery costs are refunded under the Store Terms and Conditions and applicable law.

7. If the Store exchanges a product for the same product in a different size, the exchange does not change the calculation of the Discount.

8. Complaints concerning the Promotion, including failure to apply the Discount, may be sent to shop@berriesandco.pl. The Organiser considers complaints within 14 days of receipt. Complaints concerning goods not conforming to the contract are handled under the Store Terms and Conditions.

§ 6. Personal data

1. The Organiser is the controller of Customers’ personal data. Data are processed to fulfil orders, including applying the Discount and processing returns, on the terms described in the Privacy Policy available at https://berriesandco.pl/pages/polityka-prywatnosci.

2. Participation in the Promotion does not require any data beyond those needed to place an order.

§ 7. Final provisions

1. These Terms are available in the Store in a form that can be downloaded, saved and printed.

2. The Organiser may amend these Terms only for important reasons, such as a change in the law, a decision of a competent authority, an obvious error in these Terms or a technical change in the operation of the Store. An amendment does not affect Customers’ acquired rights or orders placed before it takes effect.

3. These Terms are governed by Polish law. These Terms do not exclude or limit the rights of consumers or entrepreneurs entitled to consumer protection under mandatory law.

4. If these Terms are also published in another language, the Polish version prevails in the event of discrepancies, unless mandatory law provides otherwise.

5. These Terms take effect on 29 October 2026 at 00:00.

Appendix 1 – Excluded Products offered in the Store (as at 27 October 2026)

The list covers products published in the Store on 27 October 2026 that belong to the groups specified in § 3(1): 107 variants (SKUs) in total. Prices are those displayed in the Store on the date the list was prepared. Membership of a group listed in § 3(1) is decisive (§ 3(3)).
